CITY OF FAIRFIELD <br />ORDINA/~OE NO. 85- /4 <br /> <br />FAIRFIELD CITY CODE RELATING TO CRUISING <br /> <br />AND DECLARING SAID ORDINAl;CE TO BE AN URGENCY MEASURE <br /> <br />EFFECTIVE IbkM_EDIATELY <br /> <br /> THE CITY COUNCIL OF THE CITY OF FAIRFIELD DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1: Article XII is hereby added to Chapter 11 of <br />the Fairfield City Code to read as follows: <br /> <br />Article XII. Cruising. <br /> <br />Sec. 11.12 Definitions. <br /> <br />~enever the following words are used in this article, they <br />shall have the meanings respectively ascribed to them: <br /> <br />(a) The term "core area" shall mean that area in the City of <br />Fairfield consisting of Texas Street bounded by Pennsylvania <br />Avenue on the west and Clay Street on the east, and shall <br />include the boundary streets just mentioned. <br /> <br />(b) The words "traffic control point" shall refer to any of <br />the following intersections: Texas Street and Pennsylvania <br />Avenue; Texas and Great Jones Streets, Texas and Taylor <br />Streets, Texas and Madison Streets, Texas and Jackson Streets; <br />Texas and Webster Streets; Texas and Jefferson Streets; Texas <br />Street and Union Avenue; Texas and Washington Streets; Texas <br />and Clay Streets. <br /> <br />(c) The word "cruising" shall mean the repetitive driving of a <br />motor vehicle past a traffic control point in traffic which is <br />congested at or near the traffic control point, as determined <br />by the ranking peace officer on duty within the affected area, <br />within a specified time period and after the vehicle operator <br />has been given an adequate written notice that further driving <br />past the control point shall be a violation of this ordinance. <br /> <br />Sec. 11.12.1 Cruising prohibited. <br /> <br />Cruising is prohibited in the core area each evening from 6:00 <br />p.m. until 3:00 a.m. the next morning. <br /> <br />Sec. 11.12.2 Prerequisites to violation of Sec. 11.12.1. <br /> <br />No person shall be guilty of cruising unless he or she: <br /> <br />(a) After having been observed driving past the control point <br />on a previous driving trip, has been warned that he or she is <br />cruising upon further driving past the control point. This <br />warning shall be printed in bold and legible type, in the <br />English language upon a card not smaller than four inches by <br />six inches (4 x 6), which card shall be handed to the person <br />being warned. The card shall also state the prohibition set <br />forth in section 11.12.1 of this article, and the definition of <br />"cruising" set forth in section 11.12 of this article; and <br /> <br />(b) After having been so observed and warned, has again driven <br />past the control point which he or she drove past earlier in <br />the same 6:00 p.m. to 3:00 a.m. period. <br /> <br /> <br />
