CITY OF FAIRFIELD <br />ORDINANCE NO. 85-~ <br /> <br />AN ORDINANCE OF THE CITY OF FAIRFIELD AMENDING CHAPTER <br />25, ARTICLE I OF THE FAIRFIELD CITY CODE, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FAIRFIELD. <br /> <br /> SECTION I: <br />Zoning Ordinance <br />deleting Section <br /> <br /> Chapter 25, Article I, also known as the <br />of the City of Fairfield is hereby amended by <br />25.31 in its entirety: <br /> <br /> SECTION II: Chapter 25, Article I, <br />Zoning Ordinance of City of Fairfield is <br />adding the following section: <br /> <br />also known as the <br />hereby amended by <br /> <br />Sec. 25.31 Non-Conforming Uses and Non-Complying Facilities <br /> <br />(a) <br /> <br />General application. Except as provided by this <br />chapter or otherwise provided by law, a non-conforming <br />use may be continued, and a structure containing or <br />used by one or more non-conforming uses may be <br />maintained, or a non-complying facility may be <br />maintained. <br /> <br />(b) <br /> <br />Expansion of a Non-Conforming Use. A non-conforming <br />use shall not be altered, enlarged, expanded, or <br />extendeo. This prohibition shall include any moving, <br />enlargement, extension, expansion or alteration of a <br />non-conforming use which: <br /> <br />(i) <br /> <br />Increases the site area or floor area <br />occupied by SUCh use on the same or any <br />additional site, or <br /> <br />(2) <br /> <br />Increases the numoer of structures or the <br />size of any structure housing such <br />non-conforming use or portion thereof. <br /> <br />(c) <br /> <br />Change of a Non-Conforming Use. Except as provided in <br />Subsection (d), a non-conforming use shall not be <br />changed to or replaced by any use except a conforming <br />use. <br /> <br />File No.: Zoning Ordinance Amendment-Non-Conforming Uses/AGENDAA <br /> <br /> <br />
