OF FAIRFIELD <br /> <br /> ORDINANCE NO. 8~ ~ <br /> <br />AN ORDINANCE AMENDING CITY CODE SECTION 25.20, RELATING <br />ZONING REQUIREMENTS FOR STREET SIDE YARD FENCES. <br /> <br />TO <br /> <br /> THE CITY COUNCIL OF THE CITY OF FAIRFIELD DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION I: Section 25.20(c)(6)(A) is hereby amended <br />read as follows: <br /> <br />(A.) <br /> <br />In any residential district, no fence, wall, or simi- <br />lar structure shall be erected or altered so that <br />portions behind the front or street side yarc setback <br />line exceed six feet (6') in height. In the event <br />the ground elevation is not the same on doth sides of <br />a fence or wall, the height t~ereof may be measured <br />from the higher ground elevation. A six foot <br />hign fence may de allowed within the street side yard <br />area of a residential lot to within 10 feet from the <br />CURD, except in cases where a driveway of the adjoin- <br />ing property to ~ne rear is located within 15 feet of <br /> <br />the common property line. A six foot (6') nigh fence <br />may de allowed within the street side yard area of <br />any residential lot to within 10 feet from the curP <br />if the side yard is aOjacent To a permanent open <br />space area (drainage ditch, park, street, etc.) more <br />than 30 feet in width. <br /> <br />EXCEPTION: ~For those portions of a particular Parcel which <br />abut a city park, imoroveO or unimproved, a railroad, a <br />freeway, or other restricted access expressway, the maximum <br />fence height permitted shall ce seven (7) feet. <br /> <br /> The Planning Commission shall nave the right to allow the <br /> maximum permitted fence heigqt to be increased, through <br /> zoning, planned unit development, or subdivision pro- <br /> cedures, for those portions of a parcel which abut a rail- <br /> road, freeway, or other restricted access expressway. The <br /> maximum fence height may de increased if the Planning Com- <br /> mission finds that th additional fence height is warranted <br /> to alteviBte or buffer noise, screen undesirable vistas, or <br /> to protect the welfare of persons living adjacent to these <br /> type facilities.
