CITY OF FAIRFIELD ORDINANCE NO. 80- ~ AN ORDINANCE AMENDING CITY CODE SECTION 25.20, RELATING TO ZONING REQUIREMENTS FOR GARAGE SALES AND AUCTIONS IN "R" DISTRICTS. THE CITY COUNCIL OF THE CITY OF FAIRFIELD DOES ORDAIN AS FOLLOWS: SECTION I: Section 25.20(a)(16) and Section 25.20(a)(17) are hereby added to the Fairfield City Code to read as follows: (16) Garage sales shall be considered an "accessory use" and allowed in all "R" Districts. A "garage sale" shall be defined as the sale of personal household items and not items bought for resale. No items for sale shall be dis- played within the public right-of-way. No sale shall ex- ceed four (4) consecutive days in duration or occur more than twice a year, except that individually advertised items may be sold at any time provided no item for sale is visible from the street. (17) An "estate auction" or an auction for the purpose of sel- ling property and goods of a resident who is moving out of the City may be permitted in an "R" District provided the auction is conducted by a "bona fide" auctioneer li- censed to conduct auctions in the City. The auction shall be held on the premises of the owner of the property and goods being auctioned, and shall be no longer than three (3) days in duration. No article to be auctioned shall be displayed so as to be seen from a public street unless specifically approved by the Director of Environmental Affairs in writing. The Po- lice Chief and Director of Environmental Affairs shall ap- prove all auctions in a "R" District in writing. An auc- tion shall not be conducted on any parcel more than once a year. SECTION II: This Ordinance shall be printed and published one time in The Daily Republic, a newspaper of general circula- tion, printed and published in the City of Fairfield.
